Terms of Service
Who you are contracting with
You are contracting with Loafhosts LLC, an Ohio limited liability company based in Ohio, United States. Where this document says "we", "us" or "Loafhosts", it means that company.
Loafhosts is part of the Terabit group, owned by Silver Creek Technologies, Inc., which is why the filtering described below runs on the Terabit network. That ownership does not change who you are contracting with, which is Loafhosts LLC.
These terms cover everything we sell: game servers, dedicated servers, and the LoafHub control panel. Using any of it means you accept them.
If you are agreeing on behalf of a group, a clan, an organization or a company, you are confirming that you have the authority to bind it, and "you" then means both you and that organization.
Eligibility and your account
You must be old enough to enter a binding contract where you live, or have a parent or guardian who agrees to these terms on your behalf.
Keep your account details accurate and your credentials to yourself. You are responsible for what happens under your account, including anything done by people you invite into your organization or add as subusers. Tell us promptly if you think someone else has access.
What the service is
We provide server capacity, network transit and the panel you administer it with. We write the panel, we own and run the hardware, and we answer support ourselves.
We may change, add to or withdraw parts of the service. If a change materially reduces something you are paying for, we will tell you before it takes effect and you may cancel for the unused remainder of your term.
Payments, billing and renewals
Services are billed in advance for the term you pick: monthly, quarterly, six months or annual. Longer terms carry a discount, shown at checkout and applied for the whole term.
Recurring services renew automatically at the end of each term, at the rate recorded on your subscription, until you cancel. Canceling stops the next renewal; it does not refund the term you are in.
You can cancel at any time in the panel. There is no minimum term and no setup fee.
Prices can change. A change never applies to a term you have already paid for, and we will tell you before a renewal is charged at a new rate.
Refunds
- Game servers: 3 days. If a game server is not what you needed, ask billing within 3 days of the order and we will refund it.
- Dedicated servers: no refund. A dedicated machine is provisioned by hand and taken out of stock for you, so it is not refundable once ordered.
Add-ons, one-time fees and pre-orders follow the product they belong to. Refunds go back to the original payment method where possible, and to account credit where it is not.
Chargebacks
Talk to us before you talk to your bank. A chargeback raised without contacting billing first may result in immediate suspension of every service on the account, and we may decline to serve the account afterwards.
If a charge is wrong, we would rather fix it. Most disputes we see are a renewal somebody forgot about, and those are resolved the same day.
Suspension and termination
We may suspend or terminate a service if you break these terms, if payment fails, or if what you are running threatens our network, our other customers or us. Where the situation allows it, you get notice and a chance to fix the problem first. Where it does not, for example an active attack or illegal content, we act immediately and tell you afterwards.
For non-payment, the timeline is:
- An unpaid invoice may lead to suspension after 7 days. The server stops. Your files and world data are still on disk during suspension, and paying the invoice brings the server back with them.
- A suspended service may be terminated 10 days after suspension, which is 17 days after the invoice fell due.
- Files do not survive termination. When a service is terminated the server and everything on it is deleted, including its backups, and we cannot get it back afterwards. If you are at risk of termination, download what you need before that date rather than after it.
You may terminate at any time by canceling in the panel. On termination, by either side, any fees already due remain payable.
Disclaimers
The service is provided as is and as available. To the fullest extent the law allows, we disclaim all warranties that are not written into this document, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
Specifically, and in plain terms: we do not warrant that the service will be uninterrupted, that it will be free of errors, that any particular level of performance will be achieved in your game, or that data stored on it can always be recovered. Hardware fails, networks fail and software has bugs. What we do commit to is written in the service levels below, and that commitment is the whole of it.
Some jurisdictions do not allow parts of this disclaimer. Where that is true, this section applies to the greatest extent that jurisdiction permits, and nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud.
Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost goodwill, lost players, or the cost of substitute services, even if we were told such damages were possible.
Our total aggregate liability for all claims relating to the service, whether in contract, tort or otherwise, is limited to the amount you actually paid us for the affected service in the 12 months before the event giving rise to the claim.
Data. We are not liable for loss of your data. Backups we take are a convenience, not a guarantee, and you are responsible for keeping your own copies of anything you would be upset to lose.
These limits do not apply to liability that cannot be limited by law, and they are a fundamental part of the deal: the prices we charge assume them.
Indemnification
You will defend, indemnify and hold harmless Loafhosts LLC, its parent and affiliates including Terabit, and their officers, directors, employees and agents, against any third-party claim, and any resulting damages, losses, fines and reasonable legal costs, arising out of:
- your use of the service, including anything you host, run, store or transmit on it;
- content posted by players on a server you operate;
- your breach of these terms or of the acceptable use policy; or
- your infringement of anyone's intellectual property, privacy or other rights.
How it works in practice. We will tell you promptly about any claim we want covered, let you control the defense with counsel of your choosing where the claim is only about money, and cooperate with you at your expense. You will not settle anything that admits fault on our behalf, or that imposes an obligation on us, without our written agreement. We may join the defense with our own counsel at our own cost.
Intellectual property
The panel, our software, our branding and everything on our sites remain ours or our licensors'. You get a limited, revocable, non-transferable right to use them while your service is active, and nothing more. Do not copy, resell, reverse engineer or scrape them.
What you upload stays yours. You give us only the permission we need to host, transmit, back up and display it in order to run the service for you.
Game names, engines and workshop content belong to their own publishers and authors. We host servers for them; we do not license the games to you.
Events outside our control
We are not liable for failure or delay caused by something genuinely outside our reasonable control: natural disaster, war, terrorism, civil unrest, labor action, government order, upstream network or power failure, or an attack of a scale beyond published capacity. If such an event runs for more than 30 consecutive days, either side may cancel the affected service and we will refund the unused portion of the term.
Disputes and arbitration
Talk to us first. Most things are a misunderstanding about an invoice. Email [email protected] and give us 30 days to resolve it informally before starting anything formal. We will do the same before we start anything against you.
If that does not work, disputes are resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Ohio, with a single arbitrator. Judgment on the award may be entered in any court of competent jurisdiction.
Individual basis only. Claims are brought in your individual capacity. Class actions, collective actions, consolidated claims and representative proceedings are waived by both sides. If this waiver is found unenforceable for a particular claim, that claim proceeds in court and the rest of this section still applies to everything else.
Carve-outs. Either side may bring a claim in small claims court if it qualifies, and either side may seek an injunction in court to protect intellectual property or to stop an ongoing attack or misuse of the network, without waiting for arbitration.
Governing law
These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-law rules. Where a claim is not subject to arbitration, the courts of Ohio have exclusive jurisdiction and both sides consent to that venue.
Nothing in this section removes a right you have under the mandatory consumer law of the country you live in.
Changes, severability and the whole agreement
We can update this document. For a change that materially affects your rights we will give notice by email or in the panel before it takes effect, and continuing to use the service after that date means you accept it. Every version carries the date it was last updated.
If any part of this document is unenforceable, that part is limited or removed to the minimum extent needed and everything else stays in force. A right we do not enforce immediately is not a right we have given up.
This document, together with anything you agreed to at checkout, is the entire agreement between us and replaces any earlier version, including the separate terms, privacy policy and service level agreement it consolidates.
Subpoenas and legal requests
Law enforcement requests, subpoenas and preservation notices should go to [email protected], marked for the attention of legal, and must identify the service, the account and the period in question. We respond to valid process and, unless legally prohibited or the case involves an ongoing danger, we tell the affected customer before we produce anything. Responding to civil process may carry a reasonable compliance charge.
Acceptable Use Policy
What you may not run
These rules apply to everything on our network. They exist because one abusive customer degrades the service for everyone on the same hardware and the same transit.
- Anything unlawful where you are, where we are, or where the traffic lands.
- Attacks of any kind: denial of service, amplification, brute force, credential stuffing, port scanning or vulnerability testing against systems that are not yours.
- Running an attack service. Booters, stressers and "IP grabber" tooling are not welcome here regardless of how they are labeled.
- Malware, botnet infrastructure, ransomware, phishing pages or command and control.
- Spam and unsolicited bulk messaging, including through game chat or Discord integrations.
- Infringing content: pirated games, cracked binaries, ripped assets and unlicensed redistribution.
- Sexual content involving minors, in any form. This is reported, not warned about.
- Cryptocurrency mining, without prior written agreement.
- Tunneling, proxying or VPN services used to evade our controls or somebody else's.
- Anything that materially degrades the network or the experience of other customers.
Bandwidth, and how we enforce
Bandwidth is unmetered and expected to be used for the game servers you are running. Sustained traffic that is not that, or that destabilizes a node, may be rate limited or moved to a plan that fits.
We do not monitor the content of your servers, and we do not want to. We do act on reports, on abuse notices from upstream, and on automated signals of an attack. Depending on what we find, that means a warning, a rate limit, a suspension, termination, or a referral to law enforcement.
Report abuse to [email protected] with the IP address, the timestamp with time zone, and enough log detail to act on.
Service Level Agreement
Availability and credits
We target 99.9% availability per calendar month for hosting services, which allows about 43 minutes of unplanned downtime in a month. Availability is measured as the service responding on its own network, excluding planned maintenance and anything in the exclusions below.
If we miss it, you can claim a credit against the affected service:
- 99.0% to 99.8%: 10% credit
- 95.0% to 98.9%: 25% credit
- Below 95.0%: 50% credit
Claim within 30 days of the incident by emailing [email protected] with the service and the dates. Credits are applied to your next invoice, cannot exceed 50% of the monthly fee for that service, and are the sole remedy for missed availability.
Excluded: planned maintenance announced at least 48 hours ahead, emergency maintenance, faults in your own configuration or mods, attacks that exceed published filtering capacity, and events outside our control as described above.
Support and filtering
Support targets, measured to first human response:
- Critical, a server or service down: 1 hour.
- High, significant degradation: 4 hours.
- Normal, everything else: 24 hours.
Filtering. Attack filtering runs on the Terabit network and is included at no extra cost in every game server region except Sydney. Published capacity is 500+ Tbps of volumetric absorption and 13+ Tbps of stateful filtering. Those are two separate measurements of two different things and we never add them together. Attacks beyond that capacity, or aimed at a region without filtering, are outside the availability commitment.
Backups
Backups are a feature of the service, not an insurance policy. Take your own copies of anything you would be upset to lose, and take one before any migration, version change or large mod update.
Backups do not survive termination either. They are deleted with the service they belong to. See suspension and termination above for the timeline, and take your own copy before it runs out.
Privacy Policy
What we collect
The data controller is Loafhosts LLC, an Ohio limited liability company based in the State of Ohio, United States.
- Account data: your email address, username, and any organization details you enter.
- Billing data: invoices, what you bought, and the last four digits and card type. We never see or store full card numbers. Payments run through our payment processor, which holds the card.
- Service data: the servers you run, their configuration, and the files you upload to them.
- Technical data: IP addresses, request logs, panel activity, and the diagnostics the panel collects from your servers so it can tell you why something broke.
- Support data: tickets and the conversations in them.
Player IP addresses. Running a game server means player IP addresses reach your server and appear in its logs and in some panel views. You are responsible for how you handle them, and for telling your players if your community's rules require it.
How we use it, and who sees it
We use your data to run the service, take payment, provide support, keep the network safe, and meet legal obligations. We do not sell it, and we do not share it for anyone else's advertising.
It is shared only with the processors we need to operate: the payment processor, the email provider that sends account mail, the infrastructure and network providers that carry the service including Terabit, and the support tooling we use. Each is bound to use it only on our instructions.
We also disclose data where the law requires it, and where it is necessary to investigate abuse or protect the service. If ownership of the business changes, data moves with it, and we will say so before it takes effect.
Your rights, retention and security
You can ask for a copy of your data, ask us to correct it, ask us to delete it, object to a particular use, or ask us to hand it over in a portable form. If you are in the EEA or the UK you can also complain to your local supervisory authority; if you are in California you have the equivalent rights under the CCPA, including the right not to be discriminated against for using them.
Retention. Account and billing records are kept while the account is open and afterwards for as long as tax and accounting law requires. Server data is deleted with the service. Logs are kept for a limited operational period and then discarded.
Security. Access is limited to staff who need it, traffic is encrypted in transit, and credentials are stored hashed. No system is perfect. If a breach affects your personal data we will notify you and the relevant regulator within the time the law requires, with what we know and what we are doing about it.
Children. The service is not intended for children under 13, and we do not knowingly collect their data. If you believe a child has given us data, tell us and we will remove it.
International transfers. We run servers in the United States, Canada, Germany, the Netherlands, the United Kingdom and Australia, so your data may be processed outside your country. Where the law requires a transfer safeguard, we rely on standard contractual clauses.
